How Does the Foreclosure Process Work

How does foreclosure work? The first step in the foreclosure process is actually when you start missing your mortgage payments, or you don't pay your taxes. Most of the time, you will receive a notice in the mail, usually after three missed mortgage payments. The notice will state that unless you catch up on your back mortgage payments, your lender will be forced to foreclose on your property.

Indiana Sheriff's Sales - Local Rules, Customs and Practices Control

In Indiana, mortgage foreclosures must be judicial or, in other words, through the court system. As a general proposition, real estate collateral must be sold, pursuant to a judge's decree, by the county sheriff's office. Although the Indiana Code covers the fundamentals of the sheriff's sale process, the specific rules and procedures vary by county.

Homeowners Facing Foreclosure - The Most Motivated Sellers in the World

When I used to deal with my Orange County real estate and Las Vegas real estate clients, all my real estate investors always wanted me to hunt high and low for that magical "motivated seller". And this was in the thick of the hot markets up to later 2005 when sellers just laughed in your face at any concessions. You couldn't have a more unmotivated bunch as the sellers routinely asked, and got, waivers of contingencies for home inspections, waivers for termite inspections, waivers of loan qualifying and funding.

Don't Be Fooled by Misrepresented Foreclosure Experts

Last night I listened to a panel of real estate (investors) experts on television. They were discussing the residential foreclosure problems in this country and I was amazed at how, with the exception of one thing, little advise or help was given or touched upon for the distressed homeowner. Even the one thing that I thought could be of some encouragement when someone said to call your bank or lender and see if you can work something out. Although that is a true statement, the truth is that you need to know who to talk to; or better said: you should know who not to talk to.

Foreclosures Are This Century's Biggest Investment Possibility

Foreclosures are on the increase and the country's national Press is busy vilifying the lenders and borrowers. Certainly foreclosures, at one level, represent a market correction and a system crash that's deplorable.

Foreclosure Questions Are Dangerous Unless One is Prepared to Use Common Sense

Why? Because when one is near or in foreclosure and their mental state of mind of low esteem has gained control of their desires (make all of this go away), a thought process takes hold and one listens with SELECTIVE hearing. What makes that dangerous is a person, who is in foreclosure, will only want a way out of the foreclosure torment and thus hear only what they want to hear.

One way of getting a new house is to buy a ready made home in that place that has been repossessed by the local bank or financial establishments. Commonly referred to as foreclosure homes, these are houses that have been previously put up by their owners for mortgage for a loan but lost their right to redemption when they failed to pay back their debts in time.

Managing Foreclosure

Slow house price appreciation and slow employment growth are statistically significant factors accounting for foreclosure rates, but these factors have not been especially weak since 2001 and they are highly correlated with the share of risky loans. Other factors that are frequently mentioned do not fit the pattern of emerging foreclosure from 1995-2006, or they are not large enough to have had much substantive effect on the overall foreclosure picture. Generally, the HPA applies to residential mortgage transactions obtained on or after July 29, 1999, but it also has requirements for loans obtained before that date. This new law does not cover VA and FHA government-guaranteed loans. In addition, the new law has different requirements for loans classified as "high-risk." Although the HPA does not provide the standards for what constitutes a "high risk" loan, it permits Fannie Mae and Freddie Mac to issue guidance for mortgages that conform to secondary market loan limits. Fannie Mae and Freddie Mac are corporations chartered by Congress to create a continuous flow of funds to mortgage lenders in support of homeownership. As of January 1, 2000, mortgages in amounts of $252,700 or less are considered conforming loans. For non-conforming mortgages, the lender may designate mortgage loans as "high risk."
