Unmarried Fathers - Do You Know Your Rights?

Some of the most heartbreaking cases I've had are those of fathers not married to their child's mother and not realizing that they have to take steps to secure their legal rights to the child. In Georgia, an unmarried father has no rights to his child at all unless and until he either marries the mother and publicly claims the child as his own and gives the child his name or files a petition in court to legitimate the child. Until one of these two events happen, the mother has all parental control over the child and the father has no rights.

I live in Ohio, my kid’s mother and I lived together for a few years after we had 3 children. We split up because she developed a drinking problem. My kids lived with her for 2 years after we split up and eventually their mother ended up homeless and drinking and drugging. She allowed my children to come and live with me their ages were 3, 4 & 5. I went to juvenile court after I had already established paternity on my children and was allowed to be the residential parent of my children ordered by court. I was not aware that they made me the residential parent and the mother the legal guardian. My oldest son is now 19 and in the military, my youngest son is now 17 and in the 12th grade and still lives with me, my daughter is now 16 and went to go and live with her mother when she was 12. I am made to pay back and current child support on all my children as well as carry medical for them all. Their mother still has the same problems as before she has had 696 kids called on her at least 8 times within the time the kids came to live with me until now. She recently through my daughter out and CCDCFS claimed they were going to give me custody of her but then a month later mom wanted my daughter back and guess where she is. Why are the laws so hard on un-married fathers in Ohio? Why do mothers with a history of drug and alcohol problems continually giving the benefit of the doubt and fathers get no consideration what so ever even when they raise their children?
