What to do when the other parent claims children on taxes even though you are suppose to? When you go to do your taxes and they tell you the other parent already claimed them so you can not. I owe the IRS $3,400 because of this. Isn't there a way to show the IRS that I am the one who is suppose to claim children.

About claiming the head of household - if it looks like you have close to 50% you need to use the Custody X Change software to calculate if you really do. You might not think that you do have your kids for 50% of the time, but with the software you can actually calculate it.
