Wrongful Death in School Related Settings

Parents of school age children entrust the educators, administrators, and other staff members of a school or school district to provide a safe environment in and out of the classroom. Securing the safety of the students in their care is the most important responsibility that they have, and any failure to do so is likely to result in serious physical or emotional injury that may require extensive medical treatment or psychological therapy. Even more tragically, when lapses in student safety are sufficiently egregious a child may be killed, and under these circumstances it may be appropriate to pursue a legal action for wrongful death.

The sudden and unexpected loss of your son or daughter can have far reaching consequences in all areas of your life and it might be difficult in the midst of your grief to fully appreciate the extent of the harm that this catastrophic event has done. Although it may seem intimidating to consider the possibility of filing a lawsuit at the present, you have a limited amount of time in which to act or else you will lose your legal right to seek the financial compensation to which you are entitled.

Causes or Factors in Student Fatalities

The specific dangers to which your child may be exposed will vary considerably. Age, school location, and the nature of the activities in which your child participates all hold significant influence over the particular risks that he or she will face. Adherence to laws, regulations, and safety protocols can greatly reduce the likelihood of student fatalities, but many times the people with whom you entrust your children become so absorbed in their own worlds that they neglect the pupils in their charge. There may be some instances in which there was nothing that could have been done differently, but typically there is a degree of culpable negligence involved.

Some potential causes of or factors in student fatalities include:

  • Lack of Supervision
  • Lack of Emergency Training
  • Negligent Hiring of Bus Drivers
  • Insufficient Security Personnel
  • Chaperone Negligence
  • Construction Defects
  • Sports Injuries
  • Dangerous Facilities
