Thousands of Americans are involved in slip and fall incidents daily. What is a slip trip and fall incident? It involves an accident caused by a slippery floor or an obstacle hindering one to safely walk. An incident could take place while in a store or even while walking on a sidewalk.
Let's say you were involved in a slip trip and fall incident while entering a food store and merchandise falls on top of you or an item is broken and you slip and fall - this is a perfect example.
Before you receive any type of compensation, you must first be able to prove it. According to the law, a victim must be able to provide proof that the owner or tenant was aware of the dangerous condition. Proving this is not always considered an easy task. For example, let's say you're walking by the produce section and you see a small red cherry tomato on the ground. You try avoiding it but it's too late - you slip and fall to the ground!
After being helped up and after all the embarrassment, you wipe your shoes with a tissue from your pocket. Random thoughts come to mind about holding the food store responsible for your fall.
The thing is, there are no other cherry tomatoes on the ground and when you wiped your shoes off with the tissue, you completely destroyed evidence that may have assisted you in your case.
Now, let's say the cherry tomato was already stepped on, leaving a footprint of residue, it could have possibly been proven that the cherry tomato was already on the floor for a long time. At least long enough for an employee at the store to have cleaned it up in order to avoid any slips and falls.
If that was the possibility and the store employees failed to clean it up, you could hold the store responsible.
Some slip and fall cases are more complicated than others. That's why it takes a good Queens lawyer experienced in slip, trip, and fall cases to carefully analyze your case. It takes a good lawyer to help fight for your rights and win compensation for your settlement.
