The Landlord's Rights

If you are planning to invest on a real estate rental property, you will be kown as a Landlord. It is important to know your property owner's rights and obligations for a smooth business operation and maintain a good relationship with your tenants. Following are some landlord's rights and responsibilities.

Landlord's Rights:
1. Advertise and offer vacant units of his rental property for rent.
2. He or she has the right to screen his potential tenants.
3. The right to choose the tenant who will reside in the rental property.
4. Determine the rental agreement terms, which includes the amount of the rent and whether a pet is allowed to stay in the premises.
5. The right to collect at least a month's pay as a security deposit.
6. A property owner also has the right to require additional rent increase provided it conform to the Rent Stabilization Board Regulations.
7. The right to have access or entrance of the rental unit in emergency cases. He or she also has the right to put up decorations, improvements, supply services or show the unit to prospective buyers, workers or tenants when the property is abandoned or given up by the tenant.
8. The right to eviction proceedings under the following circumstances:
a. Non-payment of the monthly rent
b. Failure to comply with the material lease term.
c. The tenant has caused damage to the unit and would not pay for the damage to the property.
d. If the tenant refuses to a sign a new lease agreement which is the same as the old lease.
e. After receiving a notice to cease, the tenant continues to destroy the peace and quiet of the other tenants.
f. The tenant refuses entry of a landlord who has a legitimate reason for doing so. Such as to make necessary repairs which cannot be completed while tenant still resides in the premises.
g. The owner or the landlord in good faith seeks to demolish the rental property and has all the lawful permits to do so.

Landlord's Responsibilities:

1. Provide his or her tenant the name and address of the owner of the property and manager
2. Has the responsibility to repairs on the structure and the exterior of the property. Also to ensure sanitary installations such as heating and hot water installations, sinks and baths.
3. To ensure that the property is safe and fit for living.
4. He has an obligation to keep and repair the working order condition of the rooms and water heating equipment.
5. He has to comply with the current applicable building codes.
6. Maintenance on all plumbing, electrical, air-conditioning and heating equipment.
7. Provide for trash removal.
8. Supply running water for the tenants and a fair amount of hot water

When the tenant moves out, the landlord has to return the deposit to the tenant or to provide a written statement specifying his or her reason for failure to do so. The statement should be furnished within two weeks after the tenancy termination. The landlord may withhold from the deposit only the amounts important to remedy payment defaults of rent or to restore the condition of the rental unit at the beginning of the tenancy.
