When you have made the decision to buy a franchise, there are a few more things that you need to look into involving the franchise itself. Being able to look through the documents, knowing exactly what it is you should be looking for will better enable you to not only make an informed decision, but also, to have a better understanding for the business itself. Read through the entire disclosure document and make sure that you are clear on every provision it entails, and having a firm grasp of these things can help you to know before you invest. Here are a few of the key parts of this disclosure documentation.
Background, Litigation history, and Bankruptcy
These documents usually give you a bit of the business history, as well as if there have been any lawsuits, and if any of the franchiser's officers have been involved in anything regarding these areas.
These areas are pertinent because they do enable you to not only asses the trustworthiness of the franchise itself, but its financial stability and also, help you to have a better over all understanding of the business acumen.
Costs and Restrictions
The costs portion of the disclosures will go into great detail about everything from start up to fees. This section outlines many of the costs you will find in the franchise such as: Compliance with local ordinances, such as zoning, waste removal, and fire and other safety codes, continuing royalty payments as well as advertising and initial business promotion, licensing, operations costs, training and employee salaries and benefits, products or supplies costs and insurance. The restrictions portion will usually explain if there are any limits on suppliers you may use, what goods and services you are allowed to offer, and which territory you hold in the franchise.
Training and Assistance, Advertising
The training and assistance portion of the document generally lets you know what sort of support you can expect from the franchiser. This also may go into detail about what sort of long term support you will receive.
Advertising usually goes into what portion of your income will go into an advertising fund if the franchise has that, and most do. This section generally outlines where the money is going to, to what purpose, and what arrangements will be made.
Termination
This section will go into details about what things might make a franchiser terminate your agreement with them and what things you must still yet do after that termination. It also goes into how you can terminate your contract, as well as renewals and selling your franchise to another party.
These are just a few parts of the whole disclosure agreement you'll find yourself looking at- and you want to really examine all the ins and outs of the agreement, with both the franchiser and your own financial advisers. Make sure that you have a very solid understanding of each part, and what that means both in benefit to you and your own responsibilities before you sign the contract.
