With so many different types of rental contracts available how can you be sure that you are getting the right rental contract template? In fact there are really only two basic types of contracts with variations on each one. You have rental contracts for renting items such as equipment, videos and cars or you have real estate rental contracts for homes and commercial properties. These two types of contracts are very different and should be easy to distinguish between the two.

The retail rental contract will ask for all of your clients information including a driver's license number and will state the terms and conditions of renting a piece of equipment from you the owner of the business. This contract should state what the customer is renting, what he is paying for the rental and any other additional fees that he will be responsible for. This type of contract will also state what you are allowed to do if the person does not bring the equipment back, in most cases now you are allowed to collect a credit card number and charge the credit card for the amount that the item is worth.

A real estate contract is different it is based on the rental of a piece of property so the rules and laws governing its rental are far different. The same type of contact information is collected, and the rules for payment are also added, but then you will have a section of terms and conditions of the rental as well as the rights and responsibilities of the tenant and landlord. There are many laws governing these contracts such as the right of entry, notice of termination of a lease, and how much notice a tenant is required to give before they move out.

When choosing one of these contracts you should take the time to do some research and read a few samples, laws vary from state to state so it is important to understand the laws in your state before you download a real estate rental contract of any kind and use it.

There are many different variations of each type of rental contract, such as a real estate contract that is for residential or commercial rentals, another that is for renting an apartment or a room, each one has its own specifics but they are all bound together by what they share in common.
