IRS Tax Debt - Don't Agree With a Tax Levy? Use These 3 Steps For Appealing IRS Collection Efforts

IRS Attack! The IRS can be fierce if you owe them money. And if you have felt their wrath, you know their weapons are effective. The IRS can Levy your Bank Account, Seize your Assets, or Garnish your Wages. But what can you do if you feel the collection efforts are unjustified? First, be completely sure you know the IRS is wrong. Once you're sure, use this 3 step process for appealing wrongful IRS Collection actions.
Appealing Collections: This process is called "Collection Due Process" and you have the right to this if you have received any of the following notices:
Notice of Federal Tax Lien Filing and Your Right to a Hearing Under IRC 6320 (Lien Notice)
Final Notice - Notice of Intent to Levy and Notice of Your Right to A Hearing
Notice of Jeopardy Levy and Right of Appeal
Notice of Levy on Your State Tax Refund - Notice of Your Right to a Hearing (Levy Notices)
Notice of Levy and Notice of Your Right to a Hearing
Or:
Notice of Federal Tax Lien
Notice of Intent to Levy
3 Steps for the Collection Due Process Procedure:
- Complete Form 12153 "Request for a Collection Due Process or Equivalent Hearing"
- Identify ALL your reasons for your disagreements on the form
- Send the Form to the same address on your Lien or Levy Notice
Keep in Mind:
-If your request is not received withing 30 days, you are still entitled to an Appeal Hearing
-If your disagree with you Appeals determination you cannot go to court
-Your case will not be approved without reasonable cause
-You can also request a hearing if your Installment Agreement is denied or terminated
