How to Fight a Speeding Ticket in Court Myths

More myths are spreading across the internet about how to fight a speeding ticket in the courtroom. These aren't going to help you at all so don't let these be your defense.

Myth: If the officer has never read you your rights, then you can use this to win in court.

For traffic stops and speeding tickets, cops don't have to read you your rights. It's not a requirement although these rights still do apply. This doesn't work as a procedural error in court as a defense. Note though that since these rights do apply you do not have answer all the questions and aren't required to incriminate yourself and admit to speeding.

Myth: You need a traffic ticket attorney or lawyer to win in court.

The reality is that you will have a hard time finding a lawyer to help you with your ticket for less than a few hundred dollars. For most traffic violations you will spend less money on the ticket itself than hiring a lawyer to fight it. You can represent yourself in court with your own defense. The reason you get a lawyer is in the case that if found guilty you will lose your license because you have accumulated too many points against your license.

Myth: If the officer refused to show you the reading on the radar, then you can bring this up in court and win.

This actually doesn't apply at all. There isn't a state yet that actually requires the officer to show you the reading on the radar or laser gun. This won't work as a defense trying to prove the officer did a procedural error.
