How to Fight a Speeding Ticket and Win

It is possible to fight a speeding ticket and win if you are prepared.  Here is what you should if you want to beat that speeding ticket.

Generally it will be easier to fight and win a speeding ticket with solid evidence to prove your case. Sometimes heading to a judge is necessary and there a few ways that you can fight a speeding ticket in court. The following advice will assist you to make the right moves toward getting that fine canceled.

First of all, you must be confident in your position on the details surrounding your speeding ticket. There is little point in fighting a speeding ticket that you know you deserved to receive. If you believe it is inaccurate, illegal or unfair then the first step you have to take is to work out your argument. Evidence is a must. A court operates on facts alone, and you must be able to prove that you are in the right and armed with proper admissible evidence.

Make a decision on whether you're fighting with a fact or technical based defense. A fact based defense means that you were not speeding, there were obstructions to signage, or that there was no actual way for you to be aware of the speed limit broken. A technical defense also includes obstruction of proper signage, as well as any defects that may be possible in equipment or in the operation of such equipment.

Once you know what you're going to rely on, you can begin to request information. From permanently mounted radars you can request a photograph that will show your car identifiable by license plate, with a time stamp and the speed recorded. Along with this, you can request information about the calibration of the machine and any maintenance information. You can also do this for the hand-held and car-installed radars police use. If any of these details are incorrect or the machine has not been serviced in the required time frame, arguing the reasonable possibility that it is inaccurately recording speed is generally quite simple. Check your local information to find out whether or not there is legislation regarding the information from a non-serviced machine being inadmissible as is the case in some states.

If there were obstruction issues then it is vital that you take photographs of the scene as soon as possible. Your local city government should have complete maintenance records which include whether an obstruction has been reported, and the schedule for removing it. With this you can easily back up your claim and the records will allow for confirmed timing of the incident.

Don't go to court assuming you will win hoping the officer does not show up.  Although this does happen once in a while, you are best to be prepared for the officer to appear in court. It's best to assume this otherwise you could end up unprepared and lose. If their notes are sketchy or otherwise incomplete, there is not only a chance that they will not come to court, but also that if they do, the judge will form the opinion that they may not have been doing their job properly. This increases your chance of beating the fine.

Finally, always show up to court dressed appropriately - in business attire. Presenting well in the court room will lead to the judge taking you seriously. Most of all prepare your evidence and bring all required information with you on the day. Keep your temper and emotions under control at all times and listen carefully throughout the hearing for inaccuracies.
