Losing a loved one through a sudden wrongful death is a painful and shattering experience. This can be made even worse when the cause of death is due to the reckless action of another human being. Getting over the loss and the anguish of losing the loved one due to the irresponsibility of someone else can be a grueling and emotionally painful experience to a family.
In event of such a tragedy the family should be aware of the laws and regulations that pertain to the cases of wrongful death. There are legal rights that the grieving family can resort to in such trying times so they can seek to get financial damages for the traumatic death of a loved one.
The first thing that the family should do is determine the last wishes of the deceased person and make immediate burial arrangements. The family should contact a funeral home and arrange for the type of memorial service that the deceased may have indicated in his or her last wishes. The rest of the family members and other friends should also be notified.
Veterans and service members as well as their dependents can be buried in a national cemetery for free. If the person is on VA disability then allowance may be obtained for funeral and burial expenses. In the case of the finances and property of the person, the family should ensure that the deceased person's property is secured for subsequent appraisal by a legal executor.
The family should also consider the loved one's preference for a charitable trust or donation in his or her name. An obituary should be placed in the local newspapers and a person should be entrusted with the responsibility of handling all such affairs. Someone in the family should prepare a list of the donations, cards and flowers that are received so that thank you cards can be sent out.
The family members should not distribute the property of a person until its lawful appraisal has been carried out in a probate court filing by the executor. All financial changes and long term decision should be delayed in order to give the family ample time for grieving.
After the common matters surrounded the funeral are taken care of, there should be a sense of urgency for a family seeking legal action in the case of wrongful death. This is because there are limitations on the time within such action can be taken. They should not wait and the family should take the guidance of an experienced personal injury lawyer to seek redress.
