Dealing With Anchor Babies

An anchor baby is a term which is often exploited to designate those children who are born within America's borders to illegal immigrants. Arizona is currently on the verge of initiating a new state law targeted at those Anchor Babies found in their state.

There is general agreement among various circles that with the passage of their recent legislature which permitted law enforcement officers to inquire as to a person legal status Arizona made a major step in the right direction. This new endorsement however, takes the issue one step further and centers upon the offspring which has been born here on American grounds. In a nutshell, what the law will entail is that the Arizona authorities can deny a birth certificate to any children born in the state of Arizona to any parents who are not legal American citizens.

Introduced into legislation by state Senator Russell Pearce, this new bill will prevent those children from being considered U.S. citizens due to their parent's illegal status. The basis for all these related bills is that the state wished to make it difficult for illegal aliens to survive in the state and thus they are encouraged to leave for greener pastures.

The question concerning this bill is actually whether or not it violates the U.S. constitution's 14th Amendment. For those who may not be familiar with it the 14th amendment states that all persons who are born or those naturalized in America and are subject to its control are citizens of the U.S. It further details that no state may create or enforce any law which would abridge any privileges American citizens may have.

The original intent of the 14th amendment was to establish the status of citizenship for the newly freed slaves. Arizona and particularly Pearce says does not minimize this purpose in any way but indicates that the law has been "hijacked" to benefit the illegal immigrant portion of our society. Illegal's tend to use the law as a means of remaining in America and gaining access to the many benefits that they do not rightfully deserve.

Opponents of the bill indicate that passage of the legislature would not only divide the community but would instill yet another means of discrimination. Although it has been claimed that the bill possesses a lot of racial disharmony it is in fact an effort for the state of Arizona to regain control of their American citizen's rights. If left to the federal government Arizona senators feel that they will provide more support for the alien population which is in our country illegally then it will for the native born or legally certified citizen.

As it stands now the Anchor Baby Bill will take effect upon passage if the opposition does not gain 153,000 signatures in order to initiate a three year moratorium. In either case, it is likely that the bill will end up as a Supreme Court case in the near future. All we can do now is wait patiently and see what the results will be.
