Chapter 11 of Bankruptcy Helps You Pay the Debts

The Chapter 11 of the US bankruptcy code deals with the business bankruptcy. It can be used by all business organizations even if it is a corporation or sole proprietorship. But this is most commonly used by the corporations. Those who cross the debt limits for chapter 13 are to file under chapter 11. This is one of the complicated statutes in the American history.

This plan never helps the debtor restrain from paying the debt. But the debtor will be allowed o continue in business and will have to pay back the amount with the revenue obtained from the business. Further complications can occur if the business doesn't make profit. According to the repayment plan made the person under debt will have to pay creditor the amount that is left after taking the fund needed to run the business and that is needed for personal needs. Once a consensus is derived regarding the repayment plan which is passed by the bankruptcy court no changes could be made by the debtor or the creditor.

If the debtor files the case under chapter 7 or 13, then they will be required to fulfill certain tests and other requirements. But this is not applicable if a repayment plan is made under chapter 11. The debtor will be allowed to fix the plan duration. It is not usually allowed to exceed 5 years. Once the plan is prepared the debtor will have to submit it to the creditors and secure their votes. The case could proceed only if at least one of the creditors votes for the plan. If the vote is attained then it could be presented before the judge in the court for the confirmation.

Chapter 11 is considered to be most advantageous for the debtors as the debtor could decide on the content of the plan and thus the plan could be made for his interest and benefits keeping in mind the laws. It will help the business man to overcome the debt and make profit in the business.
